These terms and conditions serve as the contract between the customer and Legends & Ladyfingers. By paying this invoice, the customer is agreeing to the these terms and conditions. Terms and conditions are subject to change without notice. The term "cake" used by this Terms & Conditions refers to any dessert or item that the client ordered from Legends & Ladyfingers.

Retainers, Deposits, Payments & Taxes: The date of the event is considered “booked” upon receipt of a non-refundable deposit equaling 100% of the total value of the cake, delivery charges, equipment deposit and signed contract. Booking dates are first pay, first serve. Submit your payment ASAP to guarantee your date is not taken by another paying client. Legends & Ladyfingers does not hold dates without payment. All custom cakes should be ordered a minimum of 2 weeks in advance. Legends & Ladyfingers will only complete an order if paid for in full.  If the invoice is not paid in full before the due date, you forfeit your order, and absolutely no refund, future credit, or date change will be permitted under any circumstances.  When we take your event order, we begin the process of declining other orders. As we get closer and closer to your event date, the chances of re-booking your date are greatly reduced. If this order has been placed within 14 days of the event date, payment in full is required to confirm your reservation.  A 15% late fee will be charged each day the final payment is late.

Rush Order: Custom decorated cakes ordered within 2 weeks of the desired date will be subject to a rush fee of 10% of the order.

Liability: Legends & Ladyfingers is not responsible for bodily injury, property or consequential damage, which may result from services. Legends & Ladyfingers is not responsible for any damage to the cake or shortage of cake caused by anyone NOT employed by Legends & Ladyfingers. Legends & Ladyfingers will not deliver a cake if payments have not been paid in full. Legends & Ladyfingers is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond Legends & Ladyfingers’ control. Upon the event of a natural disaster, accident or other situation outside of Legends & Ladyfingers; control, the order may be voided. If Legends & Ladyfingers has completed the cake but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 30% of the total cost. If Client picks up the cake, Legends & Ladyfingers no longer assumes any responsibility for damage caused to it. Legends & Ladyfingers will not be liable for any special, incidental, punitive, or consequential damages, whether foreseen or unforeseen, regardless of whether liability is based on breach of contract, breach of express or implied warranty, negligence, strict liability, tort, or otherwise. Only items, actions and dessert details explicitly listed in the invoice are guaranteed by Legends & Ladyfingers.

Postponement/Cancellation: The Client must notify Legends & Ladyfingers if there is a change in the date of the event or a complete cancellation. If the postponement occurs before 10 days of the event, no penalty fee will be charged. If the postponement occurs after 10 days prior to the event, the Client will be charged a $10 fee. If a cancellation occurs 10 days prior to the date of the event, 30% of the total price will be refunded. If a cancellation occurs after 10 days prior to the event, the cake is non-refundable.

Disputes & Grievances: All disputes and grievances concerning service rendered or products provided must be submitted in writing via email within 7 days of the date of service. All food sales are final, and all payments are non-refundable. Any compensation provided in response to a dispute or grievance will be in the form of store credit only. The Parties will attempt in good faith to resolve any dispute or claim arising out of or in relation to this Agreement through negotiations between a director of each of the Parties with authority to settle the relevant dispute. If the dispute cannot be settled amicably within thirty (30) days from the date on which either Party has served written notice on the other of the dispute, the client hereby waives any and all rights to arbitration or to initiate any legal action against Legends & Ladyfingers.

Changes to Order: Any changes must be submitted 15 days in advance. There will be no changes allowed 15 days prior to the event.

Design of the Cake: Legends & Ladyfingers will follow the Client’s requests closely to create the exact cake desired. Legends & Ladyfingers cannot duplicate an exact copy of a photo or another cake artist’s work but will ensure the look is similar.

Serving Amount & Sizes: The serving size is 1-2 inches wide x 1-2 inches long x 4-5 inches high. Serving size estimations are not guaranteed to be exact. Legends & Ladyfingers is not responsible for a shortage of cake if the pieces are cut too large.

Allergy & Dietary Warnings: Legends & Ladyfingers’ baked goods may have come in contact with the following ingredients: Nuts, Dairy, Soy, Peanuts, Wheat, Sesame.

Natural dyes, artificial dyes, artificial flavorings, sugar, artificial sweeteners, artificial color and other allergens not listed. Darker colors may stain teeth and could have a residual flavor. The Client is responsible for pointing out to guests potential allergy hazards. Legends & Ladyfingers is not responsible for any adverse effects of allergic reactions.

Cake Decorations: You assume full responsibility for removing non-edible cake décor from your cake before cutting or serving. This includes but is not limited to name tags, cake toppers or any items standing on the cake, rhinestone decorations, ribbons, sugar flowers, etc. While some of these items may be made from edible materials, they may not be intended for consumption. Items such as wires, skewers, dowels, or other items are used for strength and flexibility to achieve the desired appearance of the decoration. We strongly advise against eating décor. Be mindful of placing décor items from cakes in reach of or near children and other guests.

Quality & Storage: Your order will be baked as close to your delivery/collection day as possible to ensure quality and freshness. Transport cakes on a level surface near an AC vent and away from direct sunlight. When handling a cake box grab and carry from the bottom, do not carry by the sides. Cakes are fragile and damage easily, transport with care. Cakes should be stored in a cool, dry place, preferably in the box that they are supplied in.  We suggest that cakes should be eaten as close to the delivery/collection date as possible.  Legends & Ladyfingers advises that all food must be consumed within 24 hours of the first serving. Any food consumed after 24 hours or later is at the client’s discretion and becomes their responsibility.  Once products have been delivered, the responsibility of consumption lies with the customer and, therefore, indemnifies Legends & Ladyfingers of all liability for personal use.

Pick Up / Delivery Policy: ​All cake orders must be picked up by the client or a designated representative. Delivery is only offered for large cake orders and a delivery fee will apply. If the client sends a representative to pick up their cake, the representative assumes responsibility to ensure the cake is correct as ordered. There is a delivery fee of at least $50 depending on the location. Legends & Ladyfingers is not responsible for tardiness if the venue or meeting location is changed within 48 hours of the event. The Client may pick up the cake. The Client assumes liability once it passes into the Client’s possession. The Client is responsible for providing a suitable environment for the cake (away from heaters, vibrations, people, suitable surface, suitable outdoor setting). Legends & Ladyfingers is not responsible for cake including collapse, melting, pokes etc.​​ Please be on time to collect your order. You have a 15-minute window to pick up your order. Unfortunately, we cannot guarantee that we will remain at the pick up location outside your collection window. Therefore, a fee of $30 will be applied every fifteen minutes beyond your collection window.  Late fees must be paid to collect your order.  A 10% late fee applies for pickup of next business day pick up orders. Please take the time to take your cake order, my time and other client’s orders into consideration.​ If you are early, you must wait until the agreed-upon time to collect your order.

Due to the nature of our business and our quality and freshness assurance, cakes not claimed within 72 hours of the original pick up date will be forfeited and no refunds will be provided.

 

Photographs: Legends & Ladyfingers reserves the right to take photos of the product for display or promotion without the client’s consent.
